Terms of Service — Traximus

1. Acceptance
These Terms of Service ("Terms") form a legally binding contract between you ("you", "User") and Traximus ("Traximus", "we", "us", "our"), the operator of the Traximus WhatsApp-based AI fitness companion service ("Service").
By sending any message to the Traximus WhatsApp number, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
These Terms incorporate by reference our Privacy Policy at traximus.fit/privacy (or as communicated separately).
2. Eligibility
You must be:
- At least 18 years old, OR a person of any age using the Service with verifiable parental/guardian consent (per DPDP §9).
- Legally capable of entering into a binding contract under Indian law (Indian Contract Act, 1872).
- Not a person prohibited from receiving services under the laws of India.
If you do not meet these criteria, do not use the Service.
3. The Service — what Traximus does
Traximus is a conversational AI fitness companion delivered via WhatsApp. It can:
- Take you through fitness onboarding (goals, body metrics, dietary preferences).
- Generate personalized workout plans and nutrition plans.
- Track your workouts (sets, reps, weights, duration), meals (calories, macros), water, supplements, weight, sleep, mood.
- Send reminders, daily check-ins, end-of-day reports, weekly and monthly summaries.
- Recognize meals from photos and voice notes.
- Adopt a persona of your choice (commanding officer, supportive coach, etc.).
- Be customized via "celebrity persona" mode for entertainment.
The Service uses third-party AI (Google Vertex AI — Gemini) to generate replies. All AI-generated content is best-effort and may contain inaccuracies.
4. ⚠️ Important: NOT medical, dietary, or psychological advice
Traximus is a general fitness companion, not a medical, dietary, or psychological service.
- Traximus is not a doctor, dietician, nutritionist, physiotherapist, psychologist, or any other licensed healthcare professional.
- Information from Traximus is for general fitness and wellness purposes only.
- Traximus does not diagnose, treat, cure, or prevent any disease, injury, or medical condition.
- Workout suggestions and nutrition plans are general guidance — they may not be appropriate for your specific health condition.
4.1 Consult a professional before using Traximus
Before starting any fitness program, changing your diet, or following Traximus' advice, you should:
- Consult a qualified medical doctor, especially if you have:
- Heart disease, high blood pressure, diabetes, or other chronic conditions.
- Joint problems, recent surgery, or any musculoskeletal issues.
- Pregnancy, postpartum, or are nursing.
- Eating disorders (current or past).
- Mental health conditions affecting decision-making about food/exercise.
- Any condition under active medical treatment.
- Consult a registered dietician for any significant change to your eating patterns.
- Use judgment about what feels safe for your body. Stop immediately if anything hurts.
4.2 Emergency disclaimer
Traximus is not for emergencies. If you experience:
- Chest pain, shortness of breath, fainting, severe dizziness, or any symptom you suspect is a heart attack or stroke — call emergency services (108 or your local emergency number) immediately.
- Suicidal thoughts or thoughts of self-harm — call iCall (9152987821), Vandrevala Foundation (1860-2662-345), or visit a hospital immediately.
- Severe injury during a workout — stop, do not continue, seek medical attention.
Traximus cannot help with emergencies. Do not delay medical care to message Traximus.
4.3 Eating disorder safeguard
Traximus is not appropriate for users with current or past eating disorders (anorexia, bulimia, binge eating disorder, ARFID, OSFED). Calorie tracking and rigid meal plans can be harmful in these contexts. If this applies to you, please consult a specialist; we will assist with account deletion.
5. Your responsibilities
You agree to:
- Provide accurate information during onboarding (height, weight, goals, dietary type, allergies).
- Use the Service only for personal fitness purposes.
- Not share your WhatsApp account so others use Traximus as you.
- Not attempt to abuse the AI (prompt injection, jailbreaks, attempts to extract other users' data, etc.).
- Not use Traximus for any illegal purpose.
- Not send harmful, illegal, or content violating others' rights.
- Comply with all applicable laws (Indian and your local jurisdiction).
You are responsible for the accuracy of data you share. We rely on it to generate plans — false data leads to inappropriate suggestions.
6. Acceptable Use Policy
You may NOT:
- Send spam, advertising, or solicitation through the Service.
- Send sexually explicit, hateful, harassing, or harmful content.
- Attempt to reverse-engineer, decompile, or extract our system prompts or AI models.
- Attempt to access another user's data or impersonate another user.
- Use automated tools (bots, scripts) to interact with Traximus at scale.
- Use Traximus to harm or harass third parties.
- Use Traximus to obtain advice for activities that are illegal in India (steroid procurement, prohibited substances, etc.).
We may suspend or terminate your access immediately if you violate this Acceptable Use Policy. We may report illegal activity to authorities under the IT Act 2000 and other applicable laws.
7. Subscription, fees, and payment
7.1 Free tier and paid tier
Current state — pricing to be announced:
- Free tier: Currently free for all users; usage limits may be introduced when paid tiers launch
- Paid tier: Pricing and features to be announced. We will give existing users at least 30 days' notice before any paid tier launches.
7.2 Billing
- All fees are in Indian Rupees (INR) and inclusive of GST where applicable.
- Payment is processed by to be announced; their terms also apply.
- Subscription auto-renews monthly until you cancel.
7.3 Cancellation and refunds
- You may cancel anytime by messaging "cancel subscription" on WhatsApp or via the dashboard at
traximus.fit/account. - Cancellation takes effect at the end of the current billing period.
- Refunds: prorated refund within 7 days of charge if you cancel and provide a reasonable explanation. After 7 days, no refund.
- We may refund any failed-service period (e.g. extended downtime > 24h) at our discretion.
7.4 Price changes
- We may change prices on 30 days' written notice via WhatsApp/email.
- Price changes apply at your next billing cycle. You may cancel before the change takes effect.
7.5 Failed payment
- If a payment fails, we will attempt to retry for 7 days.
- If unsuccessful, your subscription pauses (free-tier limits resume).
- Your data is retained per the Privacy Policy retention schedule.
8. Intellectual property
8.1 Our IP
The Traximus name, logo, software, system prompts, persona designs, and the design of the Service are owned by Traximus. You may not copy, modify, or redistribute them without our written permission.
8.2 Your data
You retain all rights to the personal data you share with Traximus. By using the Service, you grant us a limited, non-exclusive license to process your data only for the purposes described in our Privacy Policy.
8.3 AI-generated content
Replies, plans, and other content generated by Traximus' AI for you are licensed to you for your personal, non-commercial use. You may share them with your doctor, dietician, or trainer. You may not republish or commercialize them.
9. Service availability
- We aim for ~99% monthly uptime but cannot guarantee uninterrupted service.
- Planned maintenance windows will be communicated when feasible.
- The Service depends on third parties (Meta WhatsApp Business API, Google Vertex AI, Hostinger). If any of them is down, Traximus may be too.
- We are not liable for downtime caused by third-party service outages, force majeure, or events beyond our reasonable control.
10. Limitation of liability
To the maximum extent permitted by Indian law:
- Traximus is provided "as-is" and "as-available" without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, accuracy, or non-infringement).
- We are not liable for:
- Any injury, illness, or health outcome resulting from following Traximus' suggestions.
- Loss of weight, gain of weight, body composition changes, or fitness outcomes (or absence thereof).
- Inaccurate AI-generated information.
- Loss of data due to third-party outages.
- Indirect, incidental, special, consequential, or punitive damages.
- Our total liability to you for any claim arising from the Service shall not exceed the greater of (a) ₹1,000 or (b) the fees you paid us in the 6 months preceding the event giving rise to the claim.
Some Indian consumer-protection laws may grant additional rights that this section does not limit (e.g. under the Consumer Protection Act, 2019). Nothing in these Terms limits any non-waivable statutory rights.
11. Indemnity
You agree to indemnify and hold harmless Traximus, its directors, employees, and agents from any third-party claim, loss, or expense (including reasonable legal fees) arising from:
- Your violation of these Terms.
- Your misuse of the Service.
- Your violation of any law or third party's rights.
12. Termination
12.1 By you
You may terminate by deleting your account anytime — message "delete my account" on WhatsApp.
12.2 By us
We may suspend or terminate your access:
- For violation of these Terms (immediately).
- For non-payment after 7-day grace (auto-pause; full deletion after 90 days of inactivity).
- For any other reason on 30 days' written notice.
12.3 Effect of termination
- Free-tier accounts: your data is deleted per the Privacy Policy retention schedule.
- Paid-tier accounts: prorated refund per §7.3, then deletion.
- Sections that by their nature should survive termination (Sections 4, 8, 10, 11, 13, 14, 15) survive.
13. Modifications to these Terms
We may update these Terms as the Service evolves or law changes. Material changes will be communicated via WhatsApp/email at least 14 days before they take effect. Your continued use after the effective date constitutes acceptance.
If you do not accept material changes, you may terminate per §12.1 before the effective date.
14. Governing law and dispute resolution
14.1 Governing law
These Terms are governed by and construed under the laws of India, without regard to conflict-of-laws principles.
14.2 Dispute resolution
- Informal: First, contact us at support@traximus.fit. We aim to resolve in good faith within 30 days.
- Formal: If unresolved, disputes shall be referred to arbitration seated in [CITY — e.g. Mumbai], India, conducted by a sole arbitrator under the Arbitration and Conciliation Act, 1996. Arbitration shall be conducted in English. The award shall be final and binding.
- Notwithstanding the above, either party may seek injunctive relief in the courts at Bikaner, Rajasthan.
14.3 Consumer protection
Nothing in this section affects your rights under the Consumer Protection Act, 2019, including the right to approach Consumer Disputes Redressal Commissions.
15. General provisions
- Entire agreement: these Terms + the Privacy Policy constitute the complete agreement between you and Traximus regarding the Service.
- Severability: if any provision is found unenforceable, the rest remain in effect.
- No waiver: our failure to enforce a provision is not a waiver.
- Assignment: you may not assign these Terms; we may assign them to a successor (e.g. on acquisition) on notice to you.
- Notices to us: contact@traximus.fit + postal to Traximus, 89 Vardhman Nagar, Bikaner 334001, Rajasthan, India.
- Notices to you: via WhatsApp message to your registered number, or email if provided.
- Force majeure: neither party is liable for failure to perform due to events beyond reasonable control.
